Japan Inbound Travel SIM (KDDI) - General Terms and Conditions
These Terms are a formal legal document constituting the contract between Jenet Corporation and the User. Article 1 (General Provisions & Applicability) Standard Terms: These Terms constitute "Standard Terms of Contract" as defined in Article 548-2 of the Civil Code of Japan. They apply to the usage relationship of the "Japan Inbound Travel SIM" communication service (hereinafter "Service") provided by Jenet Corporation (hereinafter "Company"). Governing Language: The Japanese version of these Terms shall be the controlling document. In the event of any discrepancy between the Japanese version and any translation, the Japanese version shall prevail. Article 2 (Amendments to Terms) Legal Basis: The Company may amend these Terms without prior consent of the User in accordance with Article 548-4 (Amendment of Standard Terms) of the Civil Code. Notification: Amendments to these Terms shall be announced by posting on the Company's website or by other appropriate methods. Users are deemed to have agreed to the amended Terms if they use the Service after the effective date of the amendment. Article 3 (Service Content & Ownership of SIM Cards) Network: The Service is provided utilizing the network (4G LTE/5G, etc.) of KDDI Corporation (hereinafter "KDDI"). Service Area: The available service area corresponds to KDDI's service area. However, communication may be unavailable in locations where radio signals are difficult to reach, such as indoors, basements, tunnels, mountainous areas, or at sea. Lending of SIM Cards, etc.: The ownership of physical SIM cards and eSIM profiles (hereinafter "SIM Cards, etc.") provided to the User in this Service belongs to KDDI. These items are "Lent" (Loan for Use under Article 593 of the Civil Code) to the User by the Company for the purpose of using the Service, and are NOT "Sold" or transferred to the User. Article 4 (Contract Formation, Delivery & Start of Use) Contract Formation (Civil Code Article 522): eSIM: Formed when the Company issues the setup QR code, etc., after payment is completed. Physical SIM: Formed when the Company ships the product and the User receives it, or when it is physically handed over at a store, etc. Voucher: Formed when the User scans the QR code and completes the profile issuance procedure (Redemption). Definition of Start of Use (Activation): The starting point of the usage period for the Service shall be the moment the User installs the SIM Card, etc., in their device and "connects to the KDDI communication network for the first time" (Activation). Article 5 (Fees & Payment) Fees: Usage fees shall be the price displayed at the time of purchase. Tax Treatment: Residents of Japan: Consumption tax shall be added to the sales price in accordance with Article 4 of the Consumption Tax Act (Act No. 108 of 1988). Non-Residents: Sales may be treated as tax-exempt (non-taxable) if the transaction meets specific requirements under Article 7 (Export Exemption, etc.) of the same Act. Article 6 (Calculation of Usage Period & Service Termination) Calculation Method: The usage period for each plan is calculated starting from the date of "Start of Use (Activation)" as defined in Article 4, Paragraph 2, which shall be designated as "Day N." The service termination time shall be 00:00 AM (Japan Standard Time) on the day following the completion of the usage period including "Day N." (Example: 3-Day Plan) Plan: 3 Days (N + 2 days) / Start Date (N): Any time on January 1st / Termination Time: 00:00 on January 4th (Valid until 23:59 on January 3rd) Service End Date: However, in addition to the usage period of each plan, the Product itself may have a set "Expiration Date". Truncation & Expiration: Regardless of when the User starts using the Product, the Service shall automatically terminate and lose all validity upon the arrival of the aforementioned Expiration Date. (Important) Even if the usage period calculated in Paragraph 1 remains, the remaining days will be forfeited and become unusable once the Expiration Date is reached. Disclaimer: The Company shall not provide refunds or compensation for any fees corresponding to the forfeited period, even if the usage period is shortened due to the arrival of the Expiration Date. Article 7 (Restrictions, Fair Usage & Filtering) Fair Usage (Telecommunications Business Act Article 6): To ensure fair network usage, if a large amount of data is consumed in a short period or a specified limit is exceeded, communication speeds may be significantly restricted or communication may be disconnected at the discretion of KDDI or the Company. Emergency Restrictions (Article 8 of the Same Act): In the event of an emergency such as a natural disaster, general communications may be restricted to prioritize essential communications (police, fire, etc.). Child Pornography Blocking: The Company may take measures to block access to designated websites to prevent the distribution of child pornography, based on the Act on Punishment of Activities Relating to Child Prostitution and Child Pornography, and the Protection of Children. Article 8 (User Obligations, Prohibitions & Return) Device: Users must prepare a device with the Technical Conformity Mark based on the Radio Act (Act No. 131 of 1950) at their own responsibility. Management and Return of SIM Cards: Users must manage the lent SIM Cards, etc., with the care of a good manager (Civil Code Article 400). Upon termination of the contract, the User shall cut and dispose of the physical SIM card or return it to the Company in accordance with the Company's instructions. Prohibitions: Acts that may violate the Act on Prevention of Improper Use of Mobile Phones (e.g., unauthorized transfer of voice-enabled SIMs). Resale, lending, criminal acts, spamming, etc., using the Service. Article 9 (Returns, Refunds & Exchanges) eSIM (Act on Specified Commercial Transactions): Due to the digital nature of the product, NO returns or refunds are accepted after the QR code is issued, based on the "Special Provisions on Rescission of Contract (Cooling-off)" under Article 15-3 of the Act on Specified Commercial Transactions. Physical SIM: No returns or refunds are accepted for User-related reasons after delivery. However, exchanges will be made only for initial defects (e.g., card not recognized) reported within 7 days of receipt (Civil Code Article 562, Liability for Non-Conformity). Disclaimer: Inability to use the Service due to the User's device environment (e.g., SIM locked, incompatible device) is not eligible for a refund. Article 10 (Termination of Contract) If the User violates these Terms or is suspected of unauthorized use, the Company may immediately terminate the contract and suspend the Service without any notice, based on Article 541 of the Civil Code, etc. Article 11 (Exclusion of Anti-Social Forces) The User assures that they do not fall under organized crime groups, organized crime group members, or other equivalent persons (Anti-Social Forces) defined in the Organized Crime Exclusion Ordinances of each prefecture. If found to be applicable, the Company shall immediately terminate the contract. Article 12 (Disclaimer & Limitation of Liability) Application of Consumer Contract Act: If the User is a consumer, the disclaimer clauses in these Terms shall not apply in cases of the Company's willful misconduct or gross negligence (Consumer Contract Act Article 8). Limitation of Damages: In the event of damages caused to the User due to the Company's ordinary negligence, the Company's liability shall be limited to the amount of the product price paid by the User to the Company. Article 13 (Jurisdiction) For any disputes regarding this Service, the Tokyo District Court shall be the exclusive agreed court of jurisdiction for the first instance (Code of Civil Procedure Article 11). Supplementary Provisions Date of Establishment: These Terms were established on November 11, 2025. Effective Date: These Terms shall become effective as of December 15, 2025.
